Maternity Leave Details for Full-Time Employees
I have worked for PISD less than 1 year:
Your leave will be provided by the Temporary Disability (TD) policy only (maximum 180 calendar days), which will run concurrently with your Accrued Leave. When your doctor takes you off work for bed rest or delivery, your leave will begin. You must remain off work until your doctor releases you to return to work (usually 6 weeks). At that time, you must return to work on the next scheduled work day.
TD is an unpaid leave. You may request to use Leave Bank days, if you are a member. Leave Bank may only apply during the 6-week period following your delivery date, subject to the maximum of 25 Leave Bank days in the fiscal year (maximum 75 days lifetime). Additional Leave Bank time may be requested beyond that 6-week period due to complications after delivery, a secondary illness or injury sustained by the employee, or an illness or injury of the baby. Leave Bank days are not granted automatically; you must request them. Using Leave Bank days does not extend the length of your TD leave.
There is no additional time off, paid or unpaid, after your doctor releases you to return to work.
I have worked for PISD more than 1 year:
If you have also worked at least 1,250 hours in the last 12 months (determined by the Benefits department), you will qualify for the leave described below. If not, you will qualify for the leave described in the previous section. FML cannot be used intermittently for maternity leave.
Your maternity leave will be provided by the Family Medical Leave (FML) (maximum 12 work weeks in a 12-month period) and Temporary Disability (TD) (maximum 180 calendar days), which run concurrently. When your doctor takes you off work for bed rest or for delivery, your leave will begin. You must remain off work until your doctor releases you to return to work (usually 6 weeks). At that time, you may return to work, or you may choose to remain off work by using the rest of your available FML. If you have been released by your doctor, you must return to work when your FML is exhausted.
If you use all your available FML before your doctor releases you, you will then be on TD leave only. Then when your doctor releases you to return to work, you must return to work on the next scheduled work day.
FML and TD are unpaid leaves. However, the following provisions for paid time will run concurrently with your FML and/or TD leave:
- If you have saved your Accrued Leave, this will be used to pay you during the recovery period ordered by your doctor.
- If you have additional state personal leave remaining after your recovery period, you may use some or all of your state personal leave to pay you during your remaining FML leave.
- If you run out of your own Accrued Leave within the first 6 calendar weeks after delivery, and if you are a Leave Bank member, you may use Leave Bank to pay you only through the end of the first 6 calendar weeks after delivery. Additional Leave Bank time may be requested due to complications after delivery, a secondary illness or injury sustained by the employee, or an illness or injury of the baby. Leave Bank use is subject to the maximum of 25 Leave Bank days in the fiscal year (maximum 75 days lifetime). Leave Bank is not granted automatically; you must submit a Request for Leave Bank Days form.
If you have been released by your doctor to return to work, but your baby is ill, your leave will then be recorded as family illness instead of maternity leave. In this situation, please contact our office so we can assist you.

How do I request maternity leave?

What papers and doctor's notes do I need to turn in?
Posted by:The maternity leave packet will contain the forms you need to submit, which are not due until after your maternity leave begins. The packet will also contain a blank form that you can take to the hospital for your doctor to complete after you deliver.

What if both parents are PISD employees?
Posted by:If both parents are PISD employees and are eligible for FML, then the FML time off for bonding is limited to a combined total of 12 weeks and runs concurrently with any other leave. Please contact us for assistance in determining the dates of your leave.

Is my baby automatically covered on the medical plan?
Posted by:We encourage you to decide ahead of time which medical plan will cover the baby, because it's important to provide the correct insurance information to the hospital. If the hospital sends claims to the wrong insurance company, it can cause unnecessary difficulties with getting your claims paid.
If you decide to add the baby to your TRS-ActiveCare medical plan, please contact the PISD benefits department as soon as possible after the birth (no need to wait for the baby's SS#), to request the Change Form. The Change Form must be signed and returned to our office within 31 days after the birth. Change Forms submitted after the 31-day enrollment window will be denied.

How do I record my absences?
Posted by:During your recovery period, your absences must be recorded as "Personal Illness". Once your recovery period is over, any further absences must be recorded as "Unpaid Leave", unless you plan to use any remaining state personal leave.

If I do not receive a paycheck, what will happen to my health plan benefits?
Posted by:If you do not receive a paycheck or if your paycheck is insufficient, you will receive an invoice for any premiums which are due. You will have 30 days in which to make payment. If payment is not received by the due date stated on the invoice, your health plan benefits will be canceled. If your medical, dental, or vision benefits are canceled while you are on FML, you may request to reinstate the coverage and resume premium payments when you return to work after your FML.

Will the disability insurance pay during my maternity leave?
Posted by:If you were covered by the disability insurance plan before you became pregnant, then it should pay your maternity leave claim. Benefits would be based on the lower of the coverage you had at the time you became pregnant or the time your claim begins. Instructions for submitting a claim will be included with your maternity leave packet.

May I do any work while on maternity leave?
Posted by:No, you may not perform any job duties on campus or at home while on leave, nor can your supervisor require you to do so. This might include grading papers, preparing lesson plans, supervising classes or athletic events, attending PDH training or parent/teacher conferences, and other job duties. When your leave is foreseeable, your campus may require you to make advance lesson plans or other preparations to be used during your absence.

Does the 6-week recovery period ordered by my doctor include holidays?
Posted by:Yes. The recovery period does not skip over holidays, weekends, or summer months, because your physical recovery is continuing whether or not you are scheduled to be at work.

What if I am on leave the maximum length of time and cannot or will not return to work?
Posted by:At that time, the process for termination of employment must begin (see policy DEC(Local) Expiration of Available Leave), or you may choose to resign. You will be offered COBRA for any health plan benefits you have. If you are able to return to work in the future, you may apply for reemployment with the District at that time.

For campus employees - What if I deliver my baby in the summer?
Posted by:Please contact the benefits office to discuss your specific situation. If you have worked for PISD less than 1 year, you may submit a request to your supervisor to use any accrued leave you may have. If you have worked for PISD more than 1 year and are eligible for FML, you may choose to take FML at the beginning of the school year or anytime within the first year after the birth. FML may be unpaid unless you have saved up eligible accrued leave to use during this time.
